Using WhatsApp and text messages as evidence in UK courts

Messages from WhatsApp and SMS are admitted in UK courts every day - but most self-prepared exhibits are rejected or criticised for avoidable reasons: no context, no authenticity, wrong format. Here is what the rules actually require and how to prepare a message exhibit that survives.

Are WhatsApp messages admissible?

Yes. There is no rule against electronic messages; they are treated like any other document evidence. What matters is relevance and authenticity. The other side will attack whether the messages are genuine, whether they are complete (selective screenshots are a classic complaint), and whether they prove what you say.

The three attacks to pre-empt

AttackDefence
"These are faked"Keep the original phone; preserve full chats with metadata; screenshots should show contact name/number and timestamps
"You cherry-picked"Include surrounding context; if you redact, show that you did (black boxes, not deletion); never alter wording
"This proves nothing"Tie each message to an allegation or chronology entry - a message without a timeline point is noise

How to format a message exhibit

  1. Export or screenshot the full conversation, not isolated lines.
  2. Give it an exhibit number and reference it in your witness statement (statement rules here).
  3. Paginate it as part of your bundle - same continuous numbering, listed in the index (bundle rules here).
  4. Redact third parties' personal data (especially children) unless the court orders otherwise.
  5. Keep the original device untouched until the case ends.

Family court specifics

In family proceedings, PD12J cases (domestic abuse) often turn on message evidence - threats, admissions, harassment patterns. Cafcass and the court treat coherent message trails as strong corroboration. The family procedure rules' evidence provisions (FPR Part 22 and PD22A formatting) apply to your exhibits the same way as any document.

FAQ

Do screenshots of WhatsApp messages count as evidence in the UK?
Yes, if authentic and complete. Show contact details and timestamps, include context, and be ready to produce the original phone.
Can I record or screenshot someone's private messages without them knowing?
If you were a party to the conversation, capturing it is generally lawful for use in proceedings. Intercepting other people's conversations is not. Obtain legal advice on your specific situation.
