Terms of Service
Who we are
The service is available to UK residents only, for proceedings and penalty charges in England and Wales.
What the service is
EvidenceCanvas helps you organise evidence and prepare drafts for review. It is not a law firm and does not provide legal advice or representation. The platform does not sign, file or serve documents and does not conduct litigation. We do not file, serve or send documents to any court, tribunal or council, and we are not affiliated with HMCTS, the Traffic Penalty Tribunal, London Tribunals or any local authority. Documents produced are drafts for review by you and, where relevant, your professional advisers.
Using the service
- You must be 18 or over and provide accurate registration details. The service is not offered to children; if we learn an account belongs to someone under 18, we will close it and delete its data.
- Keep your credentials secure; tell us promptly about unauthorised access.
- Only upload material you are lawfully permitted to use for your case preparation, and do not use the service to harass, intimidate or fabricate evidence.
- Shared Family records. If you add another person (for example a co-parent) to a Family record, you confirm you have their consent to share that material with them, and you accept that every member can see the messages and exports in that record. Each member remains responsible for what they post.
Payment, credits and cancellation
- Paid features are charged in advance in British pounds sterling (GBP, £) through our payment processor, Stripe. No VAT is charged: Noverquis Ltd is not VAT-registered.
- Some features consume credits. Credits are consumed when a priced action is performed successfully; if a paid action fails, the charge is refunded automatically. Plan credits refresh monthly; unused plan credits carry over one month, up to one month's allowance; changing plan resets the allowance. Bought credits (packs, one-off items, Hearing Pass) never expire.
- No minimum term. You can cancel at any time from your account; cancellation stops future renewals. Statutory cancellation rights and remedies for faulty services apply in addition and are not excluded.
- Our Refund & Cancellation Policy governs refunds and cancellation rights, including your 14-day withdrawal right. Once supply of credits, a Hearing Pass or a one-off item has started at your request, the right to cancel it ends; any other refund outside your legal rights is at our discretion. The policy does not limit mandatory consumer rights.
Subscriptions and auto-renewal
- The price and billing interval (monthly) of your subscription are as shown at checkout before you pay.
- Your subscription renews automatically at the end of each billing period until you cancel it.
- You can cancel at any time from “Manage billing” in the portal (the Stripe customer portal). Cancellation takes effect at the end of the period you have already paid for; you keep access until then and are not charged again.
- If we change the price of your subscription, we will give you at least 30 days' notice by email before the new price applies, so you can cancel first if you prefer.
- By subscribing you authorise Noverquis Ltd to charge your card for future payments under these terms; your bank may ask you to confirm the payment (Strong Customer Authentication).
Refer a friend
Every account has a personal invite link in Settings. When someone signs up through your link and confirms their email address, you and they each receive 5 credits. When that person first pays for a plan, a credit pack or a one-off item, you receive a further 20 credits. You can earn sign-up rewards for up to 20 people and payment rewards for up to 25 people. Credits from referrals never expire, have no cash value and cannot be exchanged for money. Rewards are not given for your own accounts or for addresses that are never confirmed. If a payment that earned a reward is fully refunded or disputed, the reward is removed automatically (only from credits still on the account). We may also remove credits obtained in breach of these terms. If you share your link publicly or with people you do not know, say that you receive credits when they join. Never share anything about anyone's case, including your own, when you invite someone. We may change or end the referral scheme for the future; rewards already earned stay on your account.
Partner programme
Any account holder can join the partner programme from the portal and receive a partner link (a code beginning AFF-). This is separate from refer-a-friend credits. If someone signs up through your partner link, we pay you a 20% revenue share of each payment that account makes to us (excluding any tax). Your share of a payment becomes payable once the referred account has completed its first full paid month (28 days after its first payment); until then it is shown as pending. If a payment is refunded or charged back, the share earned on it is reversed automatically; if we have already paid it to you, we may deduct it from your next payout or ask you to repay it. Each account can be credited to only one partner (the first partner link it used), and you cannot earn a share on your own accounts. Revenue share is paid in pounds sterling to you; you are responsible for any tax on it. If you recommend EvidenceCanvas through your partner link, you must make clear that you are paid when people sign up; if you advise or support people professionally (for example as a McKenzie friend), you must tell them before they sign up. We may change or end the programme for the future by giving you notice; shares already earned on payments made before the change remain payable under these terms.
Your content
You keep ownership of the material you upload. You grant us the limited permission needed to store and process it to provide the service. Drafts generated for you are for your use in your case. You are responsible for checking facts, sources and requirements before using any draft.
Liability
We take reasonable care and skill in providing the service. Nothing in these terms excludes liability that cannot be excluded by law. Drafts are not legal advice; final responsibility for checking a document before use rests with you and your advisers. Our liability for direct losses is limited to the amount you paid us in the 12 months before the claim, except where the law does not allow that limit.
Complaints and termination
To complain, email support@evidencecanvas.co.uk or use the in-app Support & feedback desk. We acknowledge every complaint within 2 working days and send a final response within 14 days. If you are still unhappy: we are not a member of, and have not signed up to, any alternative dispute resolution (ADR) scheme, so we cannot refer your complaint to an ADR provider; our final response will confirm this in writing. You can get free advice from the Citizens Advice consumer service, and you remain free to take your claim to court: in England and Wales most claims of up to £10,000 are dealt with in the county court small claims track. See also our Privacy Notice and Support and safeguarding page. Sean McNamara is the named support and safeguarding contact; standard support hours are 09:00–17:00 UK time.
We can suspend accounts that abuse the service or other users; we will tell you why and how to respond.
Governing law
England and Wales. Consumer rights under English law are not affected. Our Refund & Cancellation Policy governs refunds for all EvidenceCanvas purchases.
