What makes a PCN invalid: the defect checklist

Not every typo cancels a ticket - but genuine defects do, and most drivers never check. This is the checklist: what the law says a PCN must contain, and the errors that matter at each stage.

Mandatory contents (reg 9 windscreen PCNs)

Extra contents for postal (reg 10) PCNs

The date of the notice (which must be the posting date), the grounds relied on, the payment window, and the consequences of non-payment. Camera PCNs also need the contravention evidenced - you are entitled to view the video.

Defects that bite

Defects that don't

A misspelled street, an ugly photo, a CEO's initials - adjudicators apply substance over form for trivial slips. Spend your energy on contents, dates, amounts and evidence mismatches.

How to raise a defect

Found a defect? Start at the informal challenge stage.

Photograph or scan every page. Quote the missing/mis-stated item against the regulation's requirement, state the procedural-impropriety ground, attach the timeline. Neutral, factual, dated.

FAQ

What makes a penalty charge notice invalid?
Missing mandatory contents, wrong amounts, dates that make the enforcement sequence impossible, code/location mismatches with the evidence, or service outside the legal windows - raised as procedural impropriety or 'penalty exceeded' as applicable.
Can a PCN be cancelled for a typo?
Rarely - adjudicators disregard trivial slips. Cancellation comes from substantive defects: contents, amounts, dates, evidence mismatch.
Can I ask to see the council's video?
Yes. For camera PCNs the authority must make the evidence available. Request it in writing before drafting your challenge.
