Private parking charges, audited keeper to contract

A private parking charge is a contract claim against the driver — or, only if every PoFA condition was met, the keeper. EvidenceCanvas will audit the 14-day Notice to Keeper clock, the grace period, the Beavis signage test and the £70 debt-recovery add-on, then draft the operator appeal, the POPLA/IAS pack, or the county court defence (coming soon).

Coming soon — we're checking this document builder before anyone relies on it. Official guide in the meantime: GOV.UK — Challenging a parking ticket.

What the engine does.

Coming soon — every step below is being checked before anyone relies on it.

  1. Keeper liability audit — free. Coming soon PoFA 2012 Sch 4 conditions: was the Notice to Keeper posted within 14 days of the ANPR capture, does it contain the mandatory wording, and can the operator even hold the keeper liable? If not, the charge binds no one but the driver.
  2. Grace period + signage — free. Coming soon Was there time to read the terms before parking (grace period audit)? Does the signage pass the ParkingEye v Beavis [2015] UKSC 67 prominence and legibility test — contrast, size, lighting, placement at the entrance?
  3. Unlawful fee audit — free. Coming soon The £70 debt-recovery add-on tested against Excel v Wilkinson and CPR 27.14(2)(g): where the solicitor letter is a template, the add-on may be challenged as an abuse of process, though courts have taken different views — and the exposure is computed line by line.
  4. Operator appeal — 2 credits. Coming soon The formal Stage 1 appeal as keeper: PoFA failures, signage, grace period and the contract points, in the operator's own process.
  5. POPLA / IAS pack — 3 credits. Coming soon The Stage 2 independent appeal pack, structured to the assessor's checklist with the evidence annexed.
  6. N9B defence — 4 credits. Coming soon County Court Form N9B Defence with the strike-out application where the claim is an abuse of process — and the hearing bundle (1 credit) if it goes that far.
